Terms & Conditions

of mint Pixel Heroes NFT Phase TWO.

(hereinafter: "Terms")
  1. 1.Mint Pixel Heroes NFT consists of three phases. These Terms apply to the second phase of the Mint Pixel Heroes NFT (hereinafter referred to as the "Second Phase").
  2. 2.The phases follow one another - the next phase will not begin until the previous one is over.
  3. 3.A total of 2222 NFTs will be minted.
  4. 4.Each phase is regulated by separate terms. You can read all terms here: Terms & Conditions
  5. 5.
    To join the First Phase, you must:
    1. 5.1.get listed on the whitelist - in particular, for terms and conditions on how, where and when to sign up for the whitelist follow our account on X (formerly Twitter.com) available here: Pixelcase (@pixelcase_io) / X (twitter.com). It is possible that to get an entry on the whitelist you will have to perform additional tasks, e.g., like the post on X, and add your X handle, etc. in the comments.
  6. 6.Once you meet the requirements for the whitelist entry - you can check if your wallet number is on the whitelist by going to the website: PixelCase.io (hereinafter: "Website") under the "Mint" tab. After connecting your wallet to the platform and going through the appropriate procedure in this regard, you click the "Check your wallet" button. This is when you will be shown whether your wallet is on the whitelist in the Second Phase.
  7. 7.
    The ability to check if your wallet is on the whitelist will be made available before the mint. We will provide this information directly on the Website and on our social media (hereinafter: "Social Media"):

  8. 8.The Second Phase relies on the “first come first served” principle, meaning that there is no guarantee that once your wallet number is on the whitelist you will be able to mint your NFT.
  9. 9.Information about the conduct of the Second Phase will be indicated with adequate advance notice in our Social Media and directly on the Website.
  10. 10.
    To verify that you can mint the NFT in the Second Phase you must:
    1. 10.1.access the Website during the mint,
    2. 11.2.connect your MetaMask wallet by clicking the "Connect wallet" button in the upper right corner,
    3. 10.3.check that you have an active "Mint" button, when the button says: "Sold Out" it means that you are late and there are no more NFTs available.
    4. 10.4.When the “Mint” button is active you must check that you have the correct amount of Ethereum in your wallet and an amount to pay the GAS fee (the amount of Ethereum required to purchase the NFT and the amount to pay the GAS fee will be indicated before clicking the "Mint" button),
    5. 10.5.click the "Mint" button,
    6. 10.6.accept the relevant consents,
    7. 10.7.accept the relevant consents,
  11. 11.If you can mint the NFT in the Second Phase and you fulfil the conditions described above - the NFT will be downloaded to your wallet. The downloading of the NFT to your wallet is a confirmation of the NFT sale agreement between Pixel Limited and you.
  12. 12.After the mint, the NFT will not be fully exposed in your wallet. The NFT will be automatically revealed in your wallet after 5 days from the mint.
  13. 13.In the Second Phase, while NFTs are still available, you may mint a maximum of two NFTs per wallet. You will be able to choose whether you want to mint one NFT or two NFTs before payment.
  14. 14.By purchasing the NFT, you acknowledge that you do not have the right to withdraw the purchase of this NFT.
  15. 15.You can file a complaint on mint. To do so, send us an email at: contact@pixelcase.io.
  16. 16.
    The complaint should include:
    1. 16.1.your wallet number,
    2. 16.2.indication of the reason for the complaint and the content of the request,
    3. 16.3.mint phase, which is the subject of the complaint.
  17. 17.If you do not provide us with the data indicated in above section 16, it may result in difficulty in responding or make it impossible to respond. We may ask you to provide additional information.
  18. 18.We will respond to your complaint promptly, but no later than 14 days from the date of receipt.
  19. 19.
    We reserve the right to change these Terms for important reasons, i.e. in the event of:
    1. 19.1.changes in laws affecting its content,
    2. 19.2.issuance by competent public authorities of recommendations, orders, rulings, interpretations, guidelines or decisions,
    3. 19.3.expansion, changes in the functionality of the Website, including changes in technical requirements, as well as the introduction of new services or changes to existing functionalities of the Website;
    4. 19.4.the occurrence of ambiguities, or errors that would possibly occur in the Terms;
    5. 19.5.the need to prevent abuse or for security reasons;
    6. 19.6.the need to improve the quality of service.
  20. 20.The Terms will change as of the date indicated in the notice of change of the Terms posted on the Website and/or on our Social Media. We will publish information about the change to the Terms three days prior to this change.
  21. 22.This version of the Terms is effective as of 30th October 2023.
